Karnataka High Court Issues Directives to Prevent Misuse of National Flag, Emblems, and Symbols

Bengaluru, April 25, 2025 – In a significant move to uphold the sanctity of India’s national symbols, the Karnataka High Court has issued a series of directives aimed at curbing the misuse of the national flag, emblems, and other symbols that represent the country’s pride and honor. The court emphasized that these symbols are sacred and their misuse, misrepresentation, or misstatement must be resolutely prevented.

The court’s observations came during a hearing where it expressed concern over instances of national symbols being used inappropriately, including by former legislators and parliamentarians. The court, underscored that the national flag, emblems, and other symbols embody the dignity and sovereignty of the nation, and their misuse undermines the values enshrined in the Constitution of India.

 

Key Directives Issued by the Court

The Karnataka High Court has instructed authorities to take proactive measures to ensure compliance with laws governing the use of national symbols, including the Flag Code of India, 2002, and the Emblems and Names (Prevention of Improper Use) Act, 1950. Specifically, the court directed:

1. Formulation of Guidelines: Authorities must establish clear and comprehensive guidelines to regulate the use of national symbols and prevent their misuse.

2. Strict Enforcement: Law enforcement agencies are to take immediate action against individuals or entities found violating these regulations, ensuring that the dignity of national symbols is preserved.

3. Public Awareness: The court urged the government to undertake campaigns to educate citizens about the proper use of the national flag, emblems, and symbols, fostering respect and adherence to legal provisions.

The High court remarked,
“National symbols and emblems represent the pride and honour of our nation. The misuse, mis-projection, and misstatement of these symbols, emblems, and names have to be prevented resolutely.”

It further noted that such misuse not only disrespects the nation but also erodes public faith in the values these symbols represent.

The directive has been hailed as a timely intervention to protect the sanctity of national symbols, particularly in light of reports of their inappropriate use during political events, public gatherings, and commercial activities.
